Presentation Description

In this webinar, two veteran 403(b) attorneys will review some of the significant changes to 403(b) plans that are included in SECURE 2.0, the impact of those proposals on 403(b) plan design and administration, and some as yet unresolved questions raised by the new statute. We will also examine other recent developments from the IRS and the DOL that affect 403(b) plans. Finally, we will share some dispatches from the front lines that illustrate common compliance challenges faced by 403(b) plan administrators, and that serve as a reminder that 403(b) plans still are not 401(k) plans.

Attendees will gain an understanding of:

  • Some of the provisions in SECURE Act 2.0 that will affect 403(b) plans
  • Recent developments that affect 403(b) plan administration
  • Common 403(b) compliance issues and how to address them

Speakers

Evan Giller, JD, Boutwell Fay, LLP

Evan Giller has worked in the field of employee benefits law and ERISA for over 30 years, specializing in the retirement and deferred compensation plans of tax-exempt organizations and governmental employers. He has extensive experience advising employers and plan service providers on a wide range of retirement plan issues, including plan design, plan documents, operational issues, corrections and fiduciary responsibility, and has particular expertise regarding 403(b) and 457 plans. In addition, Evan’s practice includes advising financial institutions on issues relating to the design and regulation of annuity products, in particular annuities used to fund retirement plans.

Robert Toth, JD, Toth Law and Consulting 

Robert has practiced employee benefits law since 1983. His practice focuses on the design, administration and distribution of financial products and services for retirement plans, one which combines elements of ERISA, tax law, insurance law, securities law and investment law for both 401(a) and 403(b) plans. Bob’s experience includes the design of multiple employer plans, including for 403(b) plans; implementing and fixing complex 403(b) programs; designing investment products for 403(b) and 401(k) plans; designing annuitization programs for defined contribution plans; and writing and implementing standards for fiduciary and advisory practices.
