Presentation Description

This presentation will cover recent developments in ERISA litigation matters and DOL investigations that impact plan sponsors and service providers, including 401(k) plan fee litigation and arbitration of ERISA fiduciary breach claims. The panel will share practice tips for proper plan governance and fulfillment of fiduciary duties.

Learning objectives include:

• A discussion of the pros and cons of including plan provisions requiring individual arbitration of ERISA claims
  
• The ever-continuing evolution of 401(k) fee litigation
  
• DOL investigation issues including service provider subpoenas and FOIA issues.

Presenters

R. Bradford Huss, Angel L. Garrett, and Brian D. Murray of Trucker Huss, APC in San Francisco and Los Angeles. Mr. Huss has over four decades of experience in ERISA and employee benefits and is a recognized authority on ERISA litigation and fiduciary duties. Ms. Garrett has been representing plan sponsors and fiduciaries in employee benefits and ERISA matters for over 15 years and is one of the leaders of the Trucker Huss ERISA litigation team. Mr. Murray has been litigating cases since 2013, and recently authored articles regarding attorney’s fees in ERISA litigation and the scope of ERISA’s prohibited transactions provisions.
