This presentation covers developments in the courts in ERISA litigation matters, including the latest on 401(k) plan fee litigation, employer stock litigation, arbitration provisions in plan documents, and legal defenses (such as lack of standing and statutes of limitation) to fiduciary breach litigation. The discussion will include cases currently pending before the Supreme Court and notable cases on breach of fiduciary duty claims. The panel will share practice tips for proper plan governance and fulfillment of fiduciary duties.

Rudolph of Trucker Huss, APC in San Francisco, CA – Mr. Huss has four decades of experience in ERISA and employee benefits and is a recognized authority on ERISA litigation and fiduciary duties. Ms. Kang has been concentrating her practice on employee benefits and ERISA litigation for over 15 years as one of the leaders of the Trucker Huss ERISA litigation team. Mr. Rudolph has been litigating cases since 2011, and recently authored articles regarding employer stock drop litigation and arbitration of ERISA claims.
