Smooth Sailing Ahead: Negotiating Your Ship through the New Rules for Mid-Year Changes to Safe Harbor 401(k) Plans

This webinar will include an in depth review of the recently issued IRS guidance regarding mid-year amendments to safe harbor 401(k) plans. Learn when mid-year amendments are permitted, when they are prohibited, and when it is unclear. The presentation will include a discussion of the updated safe harbor notice and election opportunity requirements and will be accompanied by numerous examples.
 
About Our Presenters

Sherrie Boutwell
Sherrie Boutwell has focused for thirty years in the areas of employee benefits law and ERISA, with an emphasis on retirement and deferred compensation plans. She advises and counsels a broad range of clients, including employers, employees, plan fiduciaries, financial institutions, government agencies and trade associations, on a wide range of employee benefits matters.  Sherrie has extensive experience and is a highly sought after speaker and writer on employee benefits topics.

Sherrie has represented clients before the Internal Revenue Service, the United States Department of Labor, the Pension Benefit Guaranty Corporation, arbitrators from the American Arbitration Association and the United States District Court with respect to employee benefits issues.  Sherrie has experience working with the unique deferred compensation issues that arise in the non-profit and governmental employer arena and also has many years of experience in the design and operation of non-qualified executive deferred compensation plans including the requirements under Section 409A of the Code.

Alison Smith Fay 
Alison Smith Fay represents employers in all aspects of employee benefit matters.  She has extensive experience with tax-qualified retirement plans including 401(k) plans. A significant portion of her practice is representing clients before the Internal Revenue Service and the Department of Labor.

Ms. Fay also provides advice regarding fiduciary responsibility issues, under ERISA.  In her work with employers, she has negotiated, advised and conducted due diligence reviews related to business mergers, acquisitions and other dispositions including resolving issues in connection with tax-qualified plan mergers and spin-offs, plan terminations, COBRA and executive compensation.

Ms. Fay also provides counsel in the design and implementation of , non-qualified deferred compensation plans,  including 409A issues. Part of her practice is to advise employers regarding  Affordable Care Act compliance, cafeteria plans COBRA and HIPAA.


 
The webinar will provide one continuing education credit for  for ASPPA, NIPA, JBEA, ERPA, MCLE CA, CPA CE for CA and OR.
